Right to Education Act forbids interviewing children’s parents

Right to Education Act prohibits the screening of children and their parents.
The Right of Children to Free and Compulsory Education Act, 2009 prohibits the screening of children and the interviewing of their parents during admissions to schools.

The new instructions for the schools put forth by the human resource development ministry state that every child has the right to get compulsory and free elementary education. As per the new guidelines issued by the HRD ministry, the schools must develop their own provisions for the admission procedure, which should be rational in character and not discriminative. Interviewing the parents during the time of admissions is unreasonable. The first child to come to the interview must get priority and the educational qualification of parents must not come under the admission criteria for the children.

As per the section 12(1) (c) of the RTE act the schools that come under specific categories must formulate rational norms for the admission procedure in the primary classes. The number of children admitted from the underprivileged category must be at least 25% of the total. For others, a justifiable and transparent policy must be formulated for admission as the guideline says.

According to section 2(n) of the act, the schools run by minority groups also come under the new guidelines published. Article 29 and Article 30 of the constitution protects the religious educational institutions like Madarasa, thus these institutions could not be included in the guidelines of the right to free and compulsory education act.
