Chuck employees who work abroad on long leave, says Court

It won’t be easy for anyone to work abroad, holding a Government job any longer. A division bench comprising of Justice CN Ramachandran Nair and Justice K Surendra Mohan of Kerala High Court said that the State Government should terminate the job of Government workers who are going abroad for career building on the assurance of a long leave. The ruling was made on a petition from Jainamma K Joseph, a nurse from Thiruvalla.

The court revealed that the Government employees taking long leave for work purpose are bound to claim pensions after completing their career in foreign countries. The court strongly rejected the petition filed by Jainamma.

Jainamma Joseph is a nurse working in Alappuzha ESI hospital in Kerala who requested for a leave of 5 years to work in Rabigh General Hospital, Saudi Arabia. The Health Department granted leave without pay. Then she requested for another 5 year leave period to continue her work in Saudi. That was also granted. This is the third time she has applied for a leave which the department rejected. As a rebuttal, she filed a petition with the High Court on March 2010.

The court found that Jainamma had no right to take a third long leave period without allowances. A single judge ordered that the State Government should not entertain this attitude of the Government employees, whose only aims to obtain as many work benefits granted by the Government as possible.

An appeal has also been filed against this verdict.
